We operate the ZeroPilot AI cloud accounting and financial forecasting platform available at zeropilot.ai.

2. Data We Collect

We collect personal and business data in the following categories:

Account Information: Name, email address, phone number, company name, and billing information provided during registration.
Financial Data: Transaction records, bank statements, invoices, receipts, payroll data, and other financial documents you share with us to enable our accounting services.
Integration Data: Authentication tokens and account information from third-party integrations you connect (Xero, Dext, Syft, and your bank feeds).
Usage Data: Log files, IP addresses, browser type, pages visited, and feature usage within our platform, collected via cookies and analytics tools.
Communications: Content of emails, chat messages, and support tickets you send to our team.

3. How We Use Your Data

We use collected data for the following purposes:

Providing, maintaining, and improving our cloud accounting and AI forecasting services
Processing financial transactions and generating reports on your behalf
Communicating with you about your account, service updates, and support requests
Training and improving our AI forecasting models (using anonymised, aggregated data only)
Complying with our legal obligations under Malaysian law (including LHDN requirements)
Detecting and preventing fraud, security incidents, and technical errors

We do not use your financial data for advertising purposes. We do not sell your personal data to any third party.

4. Data Sharing

We share data only in the following limited circumstances:

Your instructions: When you authorise connections to Xero, Dext, Syft, or your bank, we share data with those services as required to deliver the integration.
Service providers: We use AWS (infrastructure), Stripe (billing), and SendGrid (email) as sub-processors. All are bound by data processing agreements and PDPA-equivalent standards.
Legal obligations: We may disclose data when required by Malaysian law, court order, or regulatory authority (including LHDN and Bank Negara Malaysia).
Business transfer: In the event of a merger or acquisition, data may be transferred to the successor entity, subject to the same privacy commitments.

5. Data Security

We implement industry-standard security measures to protect your data:

256-bit AES encryption for all data at rest
TLS 1.3 encryption for all data in transit
Infrastructure hosted on AWS Asia Pacific (Singapore) region
Role-based access controls — staff access only the minimum data necessary
Annual third-party security audits
Multi-factor authentication required for all internal systems

6. Data Retention

We retain your data for as long as your account is active and for a period of 7 years thereafter, in compliance with Malaysian accounting records requirements under the Companies Act 2016. You may request deletion of personal data (excluding data required for legal compliance) by emailing privacy@zeropilot.ai.

7. Your Rights Under PDPA

Under the Personal Data Protection Act 2010 (Malaysia), you have the following rights:

Access: Request a copy of the personal data we hold about you
Correction: Request correction of inaccurate or incomplete personal data
Withdrawal of consent: Withdraw consent to the processing of your personal data (note: this may affect our ability to provide services)

We may update this Privacy Policy periodically. We will notify active clients via email of any material changes at least 14 days before they take effect. Continued use of our services after notification constitutes acceptance of the updated policy.

1. Agreement and Definitions

These Terms of Service ("Terms") constitute a legally binding agreement between ZeroPilot AI Sdn. Bhd. ("ZeroPilot AI", "we", "us") and the entity or individual accessing our services ("Client", "you"). By creating an account or using our services, you confirm that you have read, understood, and agree to be bound by these Terms.

"Services" refers to ZeroPilot AI's cloud accounting, bookkeeping, financial reporting, AI forecasting, and related advisory services as described on our website and in your service plan.

2. Services and Scope

ZeroPilot AI provides managed cloud accounting and financial advisory services as described in your selected plan (Clarity, Control, or Command). The specific features and deliverables of each plan are described on our Pricing page and in your service agreement.

Important: ZeroPilot AI is a technology-assisted accounting service. We are not a licensed auditor or audit firm. Our services do not constitute a statutory audit. For audit requirements, you must engage a separate licensed auditing firm.

We are responsible for the accuracy of bookkeeping based on information you provide
AI forecasts are projections based on historical data and are not guarantees of future performance
Tax advice provided is general in nature; for specific tax rulings, consult a licensed tax consultant

3. Client Obligations

To enable us to deliver our services effectively, you agree to:

Provide accurate, complete, and timely financial information and supporting documentation
Respond to requests for information or clarification within 5 business days
Grant ZeroPilot AI read/write access to Xero, Dext, and connected bank feeds as required
Not use the platform for any illegal purpose or in violation of Malaysian law
Maintain the confidentiality of your account credentials
Notify us promptly of any material changes to your business structure, ownership, or activities

4. Fees and Payment

Subscription fees are charged monthly in advance. All prices are in Malaysian Ringgit (MYR) and are inclusive of 8% Service Tax (SST) where applicable. Fees may be reviewed annually with 30 days' written notice.

Payment is due by the 1st of each calendar month. Accounts with payment overdue by more than 14 days may be suspended until payment is received. We reserve the right to charge late payment interest at 1.5% per month on overdue amounts.

5. Intellectual Property

The ZeroPilot AI platform, including its AI models, software, dashboards, and all ZeroPilot AI-created content, is the exclusive intellectual property of ZeroPilot AI Sdn. Bhd. Your financial data, however, remains your property at all times. Upon termination, we will provide a full data export in standard formats within 30 days.

6. Confidentiality

Both parties agree to maintain strict confidentiality regarding the other's confidential information. ZeroPilot AI will not disclose your financial data to any third party except as described in our Privacy Policy or as required by Malaysian law. This obligation survives termination of these Terms.

7. Limitation of Liability

To the maximum extent permitted by Malaysian law, ZeroPilot AI's total liability to you for any claims arising from or related to our services shall not exceed the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim.

We shall not be liable for: indirect, incidental, or consequential damages; loss of profit or business opportunity; decisions made based on our financial reports or AI forecasts; errors arising from inaccurate or incomplete information provided by you; or third-party service failures (Xero, Dext, Syft, bank feeds).

8. Termination

Either party may terminate these Terms with 30 days' written notice. We may terminate immediately if you breach any material provision of these Terms and fail to remedy the breach within 7 days of notice.

Upon termination: all outstanding fees become immediately payable; your access to the platform will cease; we will provide a full data export within 30 days; and your data will be retained for 7 years as required by Malaysian law before secure deletion.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any disputes shall first be subject to good-faith negotiation. If unresolved, disputes shall be referred to mediation before the Asian International Arbitration Centre (AIAC) in Kuala Lumpur. If mediation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Malaysia.

10. General

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force. Our failure to enforce any right or provision shall not constitute a waiver. These Terms constitute the entire agreement between you and ZeroPilot AI with respect to the subject matter hereof.
